The issue of medical ethics related to sentencing mentally disabled delinquents has been up for debate for a very long time.
There is an old concept saying that the degree of society civilization is defined by its attitude towards mentally disabled persons. The fascist Germany may be considered as an example of extremely negative attitude towards mentally disabled persons as all of them were killed while the fascists were in charge.
Mentally disabled persons are guilty of 10-12% of all murders committed. According to the medical community representatives, one of the gravest problems consists in the fact that sometimes mentally disabled people potentially dangerous for the society are not followed up by doctors, they are not controlled by law enforcement bodies or social services.
We must establish a boundary among morality decay, soul depravity and consequently crimes commitment and mental disorder which make mentally unstable people take uncontrolled actions contrary to the legislation.
In case a person commits an action contrary to the legislation but their mental condition is in doubt a forensic psychiatric examination is carried out. This examination helps to define whether the criminal is criminally sane or criminally insane. The court will then consider the examination results in order to decide on the sentence for the criminal.
Insane criminals are acquitted of charges so they are not put into jails but taken to psychiatric hospitals where they are provided with intensive follow-up and forced medical treatment. These hospitals possess special conditions for mentally disabled patients Each patient is given a separate cell with soft walls, transparent doors made of armored glass and accident-free furniture so the patients don’t hurt themselves. There is a huge number of surveillance cameras on the hospital premises which allow constant control of the patients. When taken to this kind of a hospital, mentally disabled persons are provided with effective treatment using the newest psychotropic substances and constantly followed up by psychotherapists. If the patients gain in mental health they may be released and put under medical supervision at their domicile. There are hundreds of cases when specially dangerous criminals were over time declared harmless by psychiatrists and released into society.
Persons on trail having the results of the forensic psychiatric examination confirming their mental disorder are subjects to forced medical treatment which may only be assigned by the court. If a person hasn’t committed anything but their mental condition may be dangerous for themselves or the society they may be subjected to involuntary psychiatric commitment.
The modern society tends to isolate dangerous mentally disabled persons, oftentimes for the life term. There is no wonder why. It is necessary to isolate society dangerous people putting them into psychiatric hospitals but not into jails as jails don’t possess special conditions, trained personnel and they don’t offer efficient medical assistance. It is really important that each mentally disabled person is constantly taken care of, given warmth and patience. These are those important conditions helping people to recover. Jails can’t help to achieve these results. Putting a mentally disabled person into a jail is contrary to the medical ethics based on the idea that a disabled person should be provided with effective medical treatment and their diagnosis sho’uld be constantly reconsidered.
