Business and law

I can imagine that I still stand in front of the gate of law library, and got a general view of the world of law knowledge. That is the reason why I can only indicate something superficial between the business and law.

In general, as we all know, the commercial law and civil law is near to the area of business. I introduce the logical connection between them. Civil law is the fundamental rule of market economy. Civil law is the embodiment of Constitution. In other words, it means business is the cornerstone of law. On the other hand, no matter which democratic country ruled by law, the common feature is the mature market of business.

Constitution and Civil law protect the civil right, such as freedom and equality of individuals, rather than the power of country or government. We knew that the civil right did not appear automatically in human history. People began to struggle for civil rights during the Revival of Letters. Why is that periods? Because the business within contemporary meaning appeared at that time. The merchant need equality for their equivalent exchange, because they need make a deal one other if they are at the equal position. Meanwhile, they need freedom for their independent management, otherwise, they are peasants who are tied by the farm and laird in the middle ages.

When the merchant became the main hierarchy of society, when they exclaimed for their own civil right, the social storm of revolution started gathering. So they signed up a contract with each other called civil law which came from their commercial habit and tradition to adjust and harmonize their behalf; standardize their business conduct to reduce benefit loss.
